Terms and Conditions

1. GENERAL
These sales conditions regulate the use of the webshop Brilatelier of Optiview BVBA - Brusselsesteenweg 608 9050 Gentbrugge with company number 0456.025.902, F.H.Optics BVBA with company number 0878.086.956 and Cool Optics BVBA with company number 0899.105.272 with registered office at 8310 St.-Kruis, Karel Van Manderstraat 147 (hereinafter referred to as 'the seller'). The sales conditions also apply whenever an order is placed via the Brilatelier webshop via www.brilatelier.be.
Brilatelier's website was commissioned and is managed by the seller. Users may view and print the information on the site free of charge for personal use, but not for commercial purposes.
Anyone who places an order on the website (hereinafter referred to as 'the customer'), confirms by placing the order that he is a natural person and also has legal capacity.
Incapacitated persons must be represented by their legal representative, who is also bound by these sales conditions and must complete the order form themselves or must grant the incapacitated person explicit permission to do so. 2. OFFER AND ORDER
An order can only be placed via www.brilatelier.be
Orders placed through the website are deemed to be placed for non-professional purposes. These general terms and conditions of sale apply only to consumers within the meaning of Book VI of the Code of Economic Law, as inserted by the Act of 21 December 2013 on the insertion of Book VI "Market practices and consumer protection" into the Code of economic law and on the insertion of the definitions specific to book VI, and of the law enforcement provisions specific to book VI, in books I and XV of the Code of Economic Law, (BS December 30, 2013; err., BS January 20, 2014, err., BS March 18, 2014, err ., B.S. An order is only final after acceptance of these general terms and conditions of sale, the prices and the description of the offer. All questions will be answered as soon as possible.
 
3. PAYMENT
The prices are those stated on the website at the time of the order. All prices quoted include 21% VAT with the exception of intra-Community shipments to holders of a VAT number, where a VAT rate of 0% applies. The customer is responsible for the correctness of the submitted VAT number. Payment must be made prior to delivery and is made via one of the following payment options: Bancontact, Maestro, Visa, MasterCard, bank transfer. If payment is made by bank transfer, the order will only be executed after receipt of the deposited amount. In the meantime, the ordered item will be reserved for 10 days, within which period the transfer must have been made and the payment must have reached the seller, otherwise the order will expire.
 
4. CONFIRMATION ORDER
After the system has accepted the aforementioned payment, the seller confirms the order by e-mail.
 
5. DELIVERY
The ordered item is delivered in Belgium either to the address specified by the customer, by collection at a postal point or post office, or by collection at an optician's shop (from our group) of your choice. The delivery period only starts after receipt of payment, even if payment is made by bank transfer. We strive for the shortest possible delivery time. The delivery period is a minimum of 1 working day and a maximum of 30 days after receipt of payment for delivery in Belgium. The seller is not liable for delay or non-delivery caused by the carrier.
 

6. RETURN
In accordance with Articles VI 47-52 of the Code of Economic Law Belgium law, the consumer has a period of 14 days to withdraw from the contract without stating that it has been repaired.

Any ordered item can be exchanged within fourteen calendar days for another item in one of the opticians' shops in the group (see list). It must be issued in the store in its original packaging together with the return form. The customer will receive a voucher at his option.

In any case, return will be personal if the item is unsoiled, undamaged and unworn and in the original packaging.

There are no costs associated except shipping costs.

If the customer chooses return via shipping, this must be sent with an insured Track and Trace code. The shipping costs are for the customer. We will not be held responsible for the loss of a returned package.

After processing and approval of the return, the customer will be refunded by the seller in the same way the customer made the payment. If desired, the customer can also opt for a voucher. A new order can be placed.

WARNING: There is NO return possible for orders with a shipping address outside BELGIUM.

 
7. WARRANTY
Any problem or defect with regard to the delivery of an article, damage or qualitative shortcoming must be reported in writing within seven days by registered letter to the address: F.H.Optics BVBA, Karel Van Manderstraat 147, 8310 Bruges or by means of a message on the contact page of the webshop or an e-mail to [email protected]. In case of identified problems, the customer must report this to the online customer service within seven days of receipt. A solution is then sought together. The return can be delivered in one of the stores. The seller offers the guarantees provided by law. The seller is not liable for force majeure, accident, misuse or incorrect handling of an item by the customer. An item with an accepted defect will be replaced or repaired free of charge. If the costs of repair are disproportionate, the seller reserves the right to replace or exchange the item with a similar item.
 
8. SIGNATURE AND EVIDENCE
The customer accepts electronic proof. The customer is solely responsible for the correctness of all data that he or she provides. With a first online order or reservation, the customer must follow the registration procedure. After this, the customer only needs to log in again to place a new order or reservation. The final confirmation of the order by the customer counts as acceptance of the order at the stated price.
